You can give him a pass on it but the constitution does not. What it does do is offer a provision.

With the Consent of Congress he can be provided with an exception.

If he can't divest then he can't be president with out breaking the law. It is in the constitution. He would be breaking the law.

You cannot give him a pass.

I don't see how Trump divest so I give him a pass on that. BUT, if he is unable to be honest with the American people, he will have trouble ahead. He needs to stop the dishonest grandstanding and treat the public with respect and dignity and most importantly - he needs to get to being truthful.
