Without a cyber treaty like the US now has with China, how do German corporations sue the People's Liberation Army?

Since sometime after 9/11 the FBI has very hefty resources to monitor internet traffic to spot commercial and national security hacking. Most of the companies who tell customers their database was hacked were told this by the FBI, just as the FBI told the Republican and Democratic Parties they were hacked in 2008 according to John McCain.

I know some here say, why don't corporations and the Republican and Democratic parties take security more seriously, but most do but they don't have the resources of state hackers in China or Russia nor the detection abilities the FBI now has.
