No, it isn't. That penalty is specifically for not buying health insurance whether you wanted it or needed it, or not.

Most of the people who buy that insurance are neither freeloaders nor are they better off for having insurance.

It gets back to his original point: If people love it so damned much why do you have to fine them to get them to take it?

Everyone agrees it is lousy insurance. And the people who have gotten it mostly didn't want it or need it, in their judgment. And something like 80% have at least part of it paid for them by taxpayers. It just sucks all to hell and back.
