You're making my point for me. What seems or doesn't seem to be in the words of the constitution varies. I just finished making a case that the 9th amendment seems to say that it protects unenumerated rights. You did not challenge my logic but rather suggested that I didn't understand what your point, which I may not have, but that's not a refutation if mine.

But that's different than taking a right that isn't mentioned at all in the constitution and calling it a constitutional right.

I'm scratching my head over your whole last post. I'm accustomed to being able to understand your points regardless of agreement. If this is an issue of terminology for you, that may be misleading because I have intentionally not used the term, "constitutional right." I spoke of natural rights and basic human dignity and enumerated and unenumerated rights and human rights.

As for the utility of the 9th amendment, it strikes me as a general principle, that is useful if people support and accept it, but has little direct legal utility in constitutional interpretation.

So, maybe the framers wanted an even ten amendments so they just threw some words together and labeled them nine?
