Ah, but Alexa, when the barkeeps refuse to serve to minors the police are right there to assist with enforement! No such police help is available under this new law. In other words, the law lacks the teeth of police power. It is a Health and Safety Code law. It may be a Labor Code Law. The law goes nowhere near the Penal Code. The barkeep is the ONLY policeman. And again, it is the business owner who will be punished--NOT the smoker!

With reference to independent contractors having the right to refuse to work in your home, all well and good. But what about the subcontractors? After all, the contractor must provide a safe, smoke-free workplace for the employees. No?

Believe me! There were oodles and scads of restaurants up SF way which did not permit smoking anywhere within their four walls. There were two right here in tiny ol' Benicia!

This has nothing to do with alcohol. Since bars are in business to serve alcohol and part of that deal is to prohibit sales to minors (it's in their licenses), it comes with the territory. To prohibit tobacco use by adults has not been and should not be part of that restriction - for whatever reason, smoking is a part of our culture, especially when one is in a bar. Many smokers would not wish to frequent an establishment where smoking was prohibited, just as many non-smokers would not wish to frequent places where smoking was permitted. Et voila! end of problem...

Perhaps I I I should consider a career in legislation.

Well thou shalt not serve alcohol to minors. That also turns poor barkeeps into policemen. I believe at the time of the Constitution minors were allowed to drink. Shall we rescind those laws?

Why not? Here in Italy we have no such laws, and many fewer alcoholics.
