It isn't a law. But an executive order. And she said her department wasn't going to defend the order because she didn't think it was defensible or even lawful. Given that Bannon isn't a legal expert, and she is, she probably is right.

This is very reminiscent of Nixon's "Saturday Night Massacre". Look how well that turned out for him.
