As a policy idea the tweak would I think be a minor positive. But the method proposed to implement it doesn't strike me as legitimate.

OTOH its just more of the same. From Trump (if this actually happens) 3.49 = 3. From Obama and the USSC and the Democrats in congress - The mandate is constitutional because its a tax, but then its not a tax when you consider that tax bills have to originate in the house (and also not a tax when they were trying to get votes for it). And exchanges established by the federal government are "established by the state". And that the Obama administration had the right to give billions in subsidies to insurance companies without congress authorizing the spending.
