I don't know. At first I think the penalties were so small there were no teeth in the law. I can remember when they increased the penalties we (accountants) began making a deal of it with clients because it could literally put someone out of business. At the same time the IRS started enforcing he Supreme Court decision which established a 5 point test on who was an employee vs. a subcontractor, and it made vast numbers of day laborers employees. I think all that was related. But it has ben too many years lol, so I don't remember the details.
