An "availability cascade" did hurt Hillary Clinton because she used a private server for government business just like Vice President Mike Pence has been doing.

Although her choices were perfectly legal at the time, the cascade of talking, messaging and broadcasting about this probably did have a real-world impact on the election because appearances often matter as much, or more, than committing an actual felony.

In my estimation her significant likability problem probably overwhelmed the effect of these availability cascades.

Of course Mike Pence says his use of a non-government email server for government business is different because of jibber-jabber and double-talk, none of it having any legal significance.

But, the Supreme Court just ruled a few days ago that private email accounts cannot be used to thwart the regulations which require all government records must be kept for the requisite periods of time.

As a result Mike Pence and everyone working in government as an employee or volunteer is now in violation of the government records act if they use a non-government email server, like an AOL, Gmail account or other non-governmental email server, for government business. The penalties vary depending on the situation.
