After just under an hour of deliberation, a jury of eight women and four men found Clarence Homer Swegheimer guilty on all counts against him.

Swegheimer, 60, was found guilty on two counts of aggravated sexual assault of a child and four counts of indecency with a child by sexual contact. He'd been indicted on three counts of each offense, but one of the sexual assault charges was given to the jury as the lesser included offense of indecency by sexual contact.

During closing arguments, prosecuting attorney Judy Price said the role of babysitters was to provide, teach and protect the children they watch. Children are told to be good, listen and do what their babysitter says, which played into the power of Swegheimer in this case, Price said.

While most children are scared of the boogeyman or monster in their closet or under their bed, Price said the victim in this case had her biggest fear come true – he blended into society and believed he’d never get caught.

The victim was told no one would believe her and those words will haunt her for the rest of her life, Price told the jury, reminding them of the tears coming down the girl's face as she testified and that she was visibly shaking while walking them through what had happened to her.

"Will you hear these girls?" Price asked the jury.

The victim and an older woman had the courage to take the stand and face their offender and Price said she hoped they as the jury would have the courage to convict him. When they do, Price said they won’t be telling him anything he doesn’t already know.

The punishment phase is scheduled to begin Wednesday at 9:30 a.m. Sweheimer is facing five to 99 years, or life in prison for each of the two counts of aggravated sexual assault of a child, and two to 20 years in prison for each count of indecency with a child by sexual contact.

Once the sentence has been recommneded by the jury, 89th District Judge Charles Barnard will determine if the terms run concurrently or consecutively.
