The Trumpcare law mandates a penalty too. It's just calculated differently. Obamacare's penalty is a tax penalty paid to the government for not being insured for the entire year. Trumpcare's penalty is a premium penalty paid to the insurer for not being insured for the entire year. Both are mandated by law and the amount of the penalty is set by law. One is a percent of MAGI, the other a percent of the insurance premium. Which one is greater depends on your income level and insurance.
