Since 39.6% is the top BRACKET, it is mathematically impossible for any taxpayer to pay a 39.6% EFFECTIVE tax rate.

You don't need to check any IRS stat to figure that out.

Another irrelevant point based on the definition of a word you inserted. Namely "effective". There are taxpayers who pay that rate on that bracket of taxable income.
