He says nobody pays 39.6%, the top marginal rate. That is a lie. Then he says nobody pays 39.6% effective tax rate. But that is because it is mathematically impossible for anyone to pay an effective rate of 39.6%, since the first couple hundred grand of income is taxed in the lower brackets. The problem is that he doesn't know the basics of the tax code. And that's a requirement in order to argue for higher rates.
