I don't think we're talking about the same thing. For HFT to be effective they computer has to be housed near an exchange.

Which is covered under "has greater capabilities" in my statement "I'm saying that people and companies who have better capabilities should generally not be handicapped by legal and regulatory authorities just because they have better capabilities."

The relevant definition of "near" in this case is based on light speed lag. Anywhere in the same city would be "near", if it has a high speed low latency, reasonably direct connection to the exchange.

Same with options.

That's even less justified and the consequences worse.
