You're missing the point. Why did it have to come to that? Why couldn't WDC work out an arrangement that was compliant with the JV agreement? Why would Toshiba be so utterly repulsed by the thought of selling the JV to a consortium that included WDC? Why did Toshiba WANT to be out of their contractual obligations? By all rights, selling to WDC should have been an easy out for Toshiba that would have been FAR more expeditious than the path they have chosen, yet Toshiba is apparently willing to add insult to injury by inclusion of at least two direct competitors to WDC in the selected buying group. They chose this time consuming and more difficult path under extreme time pressures.
