That is why I suggested that Toshiba is now giving WDC a chance to meet the latest offer, which would satisfy Toshiba's board that apparently believes WDC has only the right of first refusal, and also would satisfy WDC by allowing WDC and whatever partners it comes up with to buy the rest of the JV at a price satisfactory to WDC. The move is face saving for Toshiba and in line with what WDC sees as its contractual right.
