The following is a hypothetical conversation between South Carolina Attorney General Condon and Governor Beasley after the federal judge indicated he would send the "illegal lottery" concept back to the State Supreme Court (where they previously lost).

Desparate to find some way to save face prior to the gubernatorial election later this year, Condon and Beasley hold an emergency meeting to try to find some way out of this pickle.

Condon: Hey, I know how we'll get rid video poker! We just won't show any money in the state budget as being derived from taxes on video poker machines.

Beasley: But what about the law requiring the Department of Revenue to collect $4000 per VGM every other year? Won't they still be collecting that money?

Condon: Of course they will. But the voters don't know squat about how state budgets work. We'll just claim we aren't using video poker dollars in our budget and our constituents will think we have eliminated it.

Beasley: This is beautiful! Our supporters think we are heroes for banishing the scourge of video poker and we get a slush fund of $62 Million to do with as we please.

BROTHER! Talk about your "smoke-and mirrors" politics! Frankly, I couldn't care less whether they show these funds in their budget or not. Unless they repeal the law taxing VGM's and, therefore, VGM operators no longer have to pay taxes, they will collect and use this money. Even if they no longer tax VGM's, that is VERY different from prohibiting VGM's from operating.
