You're quite correct. I talked to a gentleman at NASD this afternoon and discussed the what the minimum requirements were forcomplying with 15c2-11. He stated that the company had to be current with all delinquent filings.

Now I'm trying to confirm that and see if there is a waiverable exception to the rule. The only exception I see would be NASD's greater responsibility to insure that shareholders are able to receive their certificates over the credibility of the actual corporate filings.

I would think this leaves NASD regulators in a bit of a quandary.

Make no bones about it... the company is almost assuredly the target of an ongoing SEC investigation with unknown outcome. As soon as this short squeeze is over, if it even occurs, the lack of fundamentals will pull the rug right back out and allow further short selling from the highs to the lows.

I really hope that we see a squeeze... regardless of how I feel about the company. It could set an interesting precedent and gain a little more respect for the collective power of internet investors.
