I doubt that the letter was sent to certain shareholders only. I haven't gotten mine yet, but I think this is because my stock is held in street name, it would arrive via my broker, and I recently moved.

I think HMAR is in a quiet period right now before earnings release, and cannot make a press release about the outlook. As far as I am aware, nothing prohibits letters to current stockholders.

I was told that it was sent to all shareholders and that it may be delayed if you hold the securities in street name since it must be processed by your broker. I was told that they decided against a press release due to advice of counsel. I would highly doubt that they would send the letter selectively for a few reasons:

1. it makes no sense
2. it is more work -- who decides?
3. attorneys were involved
4. I was told it was sent to all

It is worth checking since you claim that it is what you were told and I doubt that you would fabricate something so easily checked. Perhaps a 3rd person can call and ask if it was sent to all. Until then I believe you were victim of miscommunication.
