It isn't up to a judge to investigate the elements of an application which is presented to them by a law enforcement agency. The judge relies on the belief of information provided to them by the requesting agency. The FBI, in this instance have created a serious dilemma by the misuse of trust the court had placed in that agency. This will cause future delays and rejections of future requests of legitimate issues.
