Araq: The HVSF claim is a common patent challenge especially if you may be infringing.Vivus is very aware of the case and is taking steps to respond.
This is really a nonevent since court cases like this could take longer than the patent lasts.HVSF"S life depends on invalidating the patent since they are obviously infringing .Vivus has licensed this patent and will fight to protect it.If you are afraid that this challenge will significantly affect Vivus your fears are unfounded.The patent has been in place for 10 years so the odds are against HVSF"s claim.Vivus would never have licensed this without a thorough knowledge of the facts and some high powered opinions from the best patent attorney's.Any patent is subject to challenge but my opinion is that HVSF has a relatively difficult battle on their hands.
