MARK: A former employee has claimed co-inventorship of the applicator . I really can't elaborate but I feel the threat is minimal.This should be very easy to resolve.
The HVSF case is more of a nuisance than anything else.Without being too specific I feel this also is a nonevent.Some of the posters on the HVSF have read the recent press release and believe their patent position to be strong.I'm afraid they should be more concerned with the product at this point than a piece of paper.Their suit is premature in my opinion and has only served to involve Vivus' formidable patent attorney's in the case.If they have any money they will only waste it fighting a much more powerful and experienced adversary.
All intellectual property is subject to attack especially when the company is successful.Vivus faces a number of potential obstacles but the patent area is the easiest to defend.
