They don't. My SIL had a pitbull break through a wooden fence, kill one of their dogs and attack another one. He got his shotgun, hit the pitbull in the head with the butt to get it to release his dog and pulled it inside. They called the constables and when they arrived, they wouldn't shoot the killer dog themselves but told him he could "take care of it himself" ie put it down. Which he did. They didn't shoot my SIL even though he had a shotgun.
