I have been in a court case like this before. Luckily the courts ordered the cash be set aside (in this case a small company swallowed by a big company) The big company went bankrupt and got delisted - those of us in the small company got some money back, minus court costs.
So if the money does not exist - it will not get set aside but if there is a bigger pot than what is claimed the whole pot will not get frozen.

No biggie, you do not freeze 6 million in cash when someone is making a claim for 1 million, thats all I was attempting to point out. you can plug different numbers into the equation, the rule applies until the claim exceeds the amount available.
