Renato Mariotti ?Verified account @renato_mariotti 1/ Today the federal judge overseeing Manafort's D.C. criminal case dismissed Manafort's motion asking the judge to dismiss his indictment because Mueller exceeded his authority. This is *not* the Virginia judge who recently made controversial comments criticizing Mueller. 2/ This judge rejected Manafort's arguments for many different reasons in a 37-page, well-reasoned opinion. It is a stark contrast to the off-the-cuff comments from the Virginia judge and will likely be cited by other judges who consider challenges to Mueller's authority. 3/ Overall this result is not surprising as a legal matter, and Manafort's motion was largely a delay tactic or a "Hail Mary." But after the comments from the Virginia judge, which Trump amplified, this opinion may undercut Trump's argument that Mueller exceeded his authority. 4/ Essentially Manafort argued that the indictment against him was invalid because Mueller's investigation of him went beyond his authority, which was very broad. He was authorized to investigate "any links and/or coordination" between Russia and the Trump campaign." 5/ Mueller was also authorized to investigate "any matters that arose or may arise directly from the investigation" and attempts to obstruct his investigation or commit perjury during the course of the investigation. 6/ Manafort conceded the "Russian links" part of Mueller's authority is valid, and the judge found the indictment fell within that authority, finding it was "logical and appropriate" to investigate him because he was campaign chair and worked for a Russia-backed Ukrainian party. 7/ The judge also found the special counsel regulations, which were created to internally manage the Justice Department, did not give Manafort or other individuals under investigation any rights at all. He didn't challenge DOJ's authority, just the part of DOJ that charged him. 8/ The judge also found that Mueller had authority to investigate Manafort under the "any matters that arose or may arise directly from the investigation" piece of his authority, which is what most legal observers assumed she would focus on because it is so broad. 9/ The judge deliberately did not solely rule based on that part of Mueller's authority because Manafort claimed that it was too broad. Because she came up with multiple reasons why Manafort's motion should be denied, her ruling will stand on appeal if any *one* reason is valid. 10/ Overall, this opinion details a number of different ways in which Mueller is acting within his authority, including ongoing verbal and written authorization from Rosenstein. The judge's opinion should discourage other defendants from making similar motions. /end
