Clapper is making that claim because that will become his defense for being part of the entrapment scheme. If somehow the public can be made to believe the Russians swung the election to Trump, the public is more likely to excuse the entrapment and unlawful surveillance. It will be presented as things the intelligence agencies HAD to do in order to protect the democracy. If this is proved, are you OK with it? This is not the same as the courts putting restraints on a president. Action by the courts is legal and open to public view.
