Apple has now taken an inconsistent position by arguing in the Samsung lawsuit that the damages should be based on the phone rather than just the design patents infringed. A litigant cannot take inconsistent positions in different law suits. While Apple will likely argue it isn't inconsistent because a "design patent" is different, that seems to me to be a flimsy distinction. Now that Apple has received a benefit (the favorable jury verdict), it's stuck. It might hope that the judgment is reversed on appeal and remanded for a new trial. IMHO opinion Apple has just screwed itself regarding its position vis a vis Qualcomm.
