Criminal intent in fraud or corruption or similar cases requires that prosecutors show that the defendant had the intent, as in what he/she was thinking. I don't know. I was always taught that it is one of the reasons there are so few cases of tax fraud proved. Trump's having written the letter could really be a problem, although again, I'm not sure that alone would be proof. I guess we'll see.
