Wharf can correct me if I am wrong but in California our State Constitution creates the Office of Attorney General as a separate Constitutional Office, independent from the executive branch and governor to ensure that the office is not subject to undue influence or constraint. So if Dersh was alluding that the US Constitution got it wrong by placing the AG under the executive then maybe. I did not read his comments in full or in the context he gave to be sure of his meaning.

He said the Constitution was wrong that it allows the Attorney General to not be personally loyal to the president. In context, his statement still means the same.

To make that claim shows a fundamental misunderstanding of the Constitution. It would be wrong for it to encourage the head of the DOJ or any department to be personally loyal to a president.





I think you should watch the video. He is simply pointing out that the C doesn’t discourage, as does that of other western nations, creating this position of inherent conflict. And he points out the ultimate loyalists, Bobby Kennedy and bundler Eric Holder holding the position for which Trump is criticized.

Objectively, Dershowitz is indisputably correct that loyalty from one's brother is going to be absolute yet the C did not prevent his holding that position.

I’m certainly no expert on constitutional law, but I’m smart enough to know one when I see him and if Dershowitz says it I can assure you no one on this thread is qualified to argue the point. Aside from the fact he made the point eloquently.
