Mike,

first theres the question of where the patents are filed - what countries did the Japanese company file in (maybe only Japan a small % of Radica sales, maybe in US a large % of Radica sales). Then theres the question of what IP protection Radica has and to what extent it conflicts with IP protection of Japanese company. Then theres the question of venue, court or arbitration etc. Then theres the question of what I would call widget patents (very easy to overcome) versus broader process patents (more difficult to overcome). I've seen companies who painted their widget patent opponents into corners by using broader process patents. Some companies are in business to sue other companies - the smart ones just say no and flex some muscle to show they mean business. Many opponents back down at that point.
