When private business does it, it's not a law, it's just a condition of employment.

Private businesses can create conditions of employment, but they are subject to local, state and federal labor laws, as well as any applicable collective bargaining agreements.

In this case, the NFL has an agreement with the players' union, and under that agreement the NFL may not make unilateral decisions restricting players' freedom of speech while in the workplace.

Any restriction the NFL wants to make limiting the players' freedom of speech in the workplace will have to be agreed to by the players' union.

A player quietly kneeling, while the anthem is being played, to protest systematic murder of black citizens by government employees can't be equated with an employee cursing someone else in the workplace, or yelling "fire".

Surely it must be obvious to you that "Captive Audience" is a restriction placed on employers, not employees, and has no bearing on any discussion of restricting the free speech of employees.

I don't know what you mean when you say television broadcasters are not "subject" to the first amendment. Do you mean they are not protected by it? Please cite an example illustrating the point you're trying to make.

About my consumption of news, as long as I continue to avoid FOX News, I think I'll be very well-informed.
