DAVID: Vivus apparently saw a much greater threat than I.The plaintiff had a good point but I would have been more aggressive than Vivus.In the overall skeme of things they felt protecting their patent position far outweighed the $ 5 MM pay off.They were able to keep their intellectual property in place which is obviously more important over the long haul. I'd rather not say toomuch more since I seem to be every ones favorite target but this is a minor blip when taken in the context of a multimillion $ drug. GV
