Footage of a jarring, racially charged attack on an Asian passenger riding the subway in New York has gone viral.

The New York Police Department said Anna Lushchinskaya, 40, has been charged with two counts of felony assault after the incident, which occurred during the morning rush hour on Tuesday aboard the D train in Brooklyn.

A 24-year-old woman was left bleeding with cuts to her face, the police said.

In the video shared by Juan Ayala on his Twitter account PlatanoMan, Lushchinskaya is seen screaming “f**k off” several times before apparently preparing for her attack by putting her sunglasses in her handbag and tying back her hair. She then lashes out with her umbrella and key chain.

After an Asian man intervenes, Lushchinskaya, who is white, screams “f**king chink”, which prompts surrounding passengers to shout the attacker down.

The dispute began after the suspect bumped into the complainant, according to the police report. The man who intervened, 30, also sustained scratches, it said.

“I'm lucky that she didn't have anything like weapons on her – like knife, gun – because it could have got a lot worse,” the victim, who wishes to remain anonymous, said after the attack, according to New York’s Channel 7 Eyewitness News.

“I'm lucky that people were on the train who were helping me, especially the first Asian guy who stood in front of me right away because he wasn't recording,” the report quoted the victim as saying.

“He just stood in front of me to help me, because I know other people were recording, but their recording didn't do anything until later on when it escalated.”

The video had attracted 4.5 million views on Facebook as of Friday. Some of the more than 1,700 comments included complaints that more people surrounding the attacker did not try to stop the assault.

How to avoid falling prey to 'tanim bala' scheme


Metro Manila (CNN Philippines) — Numerous passengers — foreigners included — have been complaining in the recent weeks of being framed for possession of live ammunition in their luggage in various Philippine airports.

The Philippine National Police-Aviation Security Group (PNP-AVSeG) recorded 30 alleged cases of "tanim bala" [planting of bullets in luggage] or "laglag bala" [dropping of bullets in luggage] from January to November 2015, while the Manila International Airport Authority (MIAA) recorded five alleged cases in the past two weeks.

Presidential Communications Operations Office (PCOO) Secretary Herminio Coloma Jr. earlier called the reported cases as isolated, but he said the government was investigating the matter.

The "tanim bala" scheme allegedly involves airport security officials who plant live ammunition in order to extort an exorbitant amount of money from the passenger caught with the planted bullet inside their luggage.

Under Republic Act 10591, it's unlawful for anyone to possess or buy firearms and ammunition without the license to do so.

To avoid falling prey to the "tanim bala" scheme, Joseph Plazo of Plazo Associates Law shared his tips as a lawyer on how you can protect your luggage and how you can practice your legal rights if you become a victim of the alleged scam.



Use hard-case luggage, avoid bags that have external pocketsSome concerned citizens have posted videos of how easy it is to pry open the zippers of a padlocked luggage; all it will need is a ballpoint pen to dislodge the zipper to open the bag with locks and you won't even know that your luggage was tampered.

Plazo advised travelers to choose a hard-case luggage sealed with heavy-duty padlocks, so the passenger would easily know if their bags had been tampered.

He also suggested using luggage without external pockets. If it has external pockets — no matter how small or seemingly hidden — don't forget to secure it with heavy-duty padlocks.

Wrap your entire luggage in cling wrapIf you already have a luggage that is not a hard case, you can still opt to use it, but add a tightly-wrapped layer of cling wrap around your luggage for safety.

"Wrap the entire bag in plastic. The shrink wrap makes sticking in a bullet difficult," he said.

MIAA spokesperson Dave de Castro said that a new service to wrap travelers' bags is now available at airport terminals and a numbers of passengers had already availed of the service.

Let the officials go through your bag — but only in the presence of witnesses, a lawyer, and official's supervisorEric Apolonio, spokesperson of the Civil Aeronautics Association of the Philippines (CAAP), advised travelers to keep an eye on their luggage at all times, even as it goes through the airport security X-ray and walk-through metal detectors.

If an airport security employee claims to have seen a bullet in the X-ray of your luggage and insists that you are carrying contraband and proceeds to open your bag, Plazo said that you have the right to delay the opening of your bag until your lawyer, the airport official's supervisor, or third-party witnesses arrive.

When your lawyer, the official's supervisor, and witnesses are already with you, open the locks of your bag, and let the airport officials take it from there.

Plazo stressed that you should let the airport official go through the contents of your bag and find the alleged bullet seen in the X-ray, adding that if the bullets were planted, it will not bear your fingerprints.

"A bullet with none of your fingerprints sheds reasonable doubt on the possession of the said item," Plazo said.

You have the right to remain silent Section 12 of the Philippine Bill of Rights in the 1987 Constitution clearly states that you have the right to remain silent.

Plazo added that, if the airport officials demand you to admit that you own the bullet found in your luggage, you can stand by your right to remain silent and that any admission you might be forced to make without the presence of a lawyer would be inadmissible in court.

Know your legal rightsPlazo reminded air passengers that no police officer can set bail, as only judges are empowered by law to set bail.

"Corrupt officials may say: 'Sir, you simply have to pay [extortion amount here], and we'll let you go.' This is a trap," Plazo said.

Public officers proved to have violated the Anti-Graft and Corrupt Practices Act RA 3019 will be punished by a fine or imprisonment.

If the airport officials detain you arbitrarily, Plazo said you have ammunition to fight back by filing a petition for a writ of habeas corpus or a complaint of arbitrary detention.

"Habeas corpus is a legal proceeding to obtain liberty. The remedy is proper where the rogue authorities have no probable cause nor basis to hold you, while arbitrary detention is a crime equivalent to illegal detention, more popularly known as kidnapping," Plazo stated.

The Good Samaritan who carried out a citizen's arrest on board a D train in Brooklyn after a woman attacked another female passenger has opened up about his act of heroism.

Juan Ayala, 31, better known by his colorful nickname, 'Platano Man,' was seen on video restraining 40-year-old Anna Lushchinskaya at the 36th Street station in Brooklyn during the morning rush hour Tuesday.

Ayala, who works security and also has his own podcast, jumped into action after Lushchinskaya assaulted 24-year-old Michelle Tung with her umbrella and keys, and hurled a racial slur at her invoking the victim's Chinese heritage.

Ayala, who filmed one of the viral videos documenting the violent altercation, said Tung seemed extremely non-threatening and he had no idea what she possibly could have done to provoke the attack.

‘She had a bow on her head,’ he told the . ‘You can’t get any more innocent than that. That’s, like, a staple of innocence.’

The brave straphanger, who is of Dominican descent, said he decided to step in and perform a citizen's arrest on Lushchinskaya after the blond woman apparently mistook him for a Muslim person and called him by the name of one of the 9/11 terrorists, Muhammad Atta.



Ayala said as a Dominican man, he was glad that he had seven or eight witnesses to vouch for him after he restrained the Brooklyn lawyer for beating another woman on the train

'B****, I'm Dominican,’ Ayala shot back. 'I just had a bacon, egg and cheese yesterday. Literally the whole world is laughing at you.'

Lushchinskaya then turned her rage at the Good Samaritan, knocking his cell phone out of his hands and spitting on him.

After the 40-year-old woman took a swing at Ayala while brandishing a set of keys and declaring that she was an attorney, Ayala grabbed hold of her arms and pinned them behind her back.

‘Without those seven or eight witnesses, if those cops saw a black guy holding onto a blond girl, I probably would have been shot,’ the heroic commuter said. ‘I was a little freaked out. I’m not gonna lie.’

Tung previously said that Lushchinskaya, whom she did not know, targeted her as soon as she boarded the train shortly before 8am Tuesday.

At first, she did not think the Brooklyn attorney was addressing her when she repeatedly yelled, 'f*** off.' But then Tung said Lushchinskaya purposefully bumped into her.

The victim, 24-year-old Michelle Tung, who did not wish to show her face on camera, said that she did nothing to provoke the attack on board the D train Tuesday
'And I said, "Don't touch me with your bag," and then that's when the video started with the "f*** off,"' Tung told , referring to at least two viral cellphone recordings showing the violent altercation.

'She hit my phone and my hands,' Tung recalled, adding that she was scared, especially when Lushchinskaya grabbed a set of keys in her hand.

'I'm lucky that she didn't have any weapons on her, like knife, gun, 'cause it could've got [sic] a lot worse,' Tung said.

Tung said hearing Lushchinskaya use a racial slur against her 'really pissed' her off.

'It's fine, you're calling my a c***k, but I really am Chinese. I'm proud where I came from... I'm proud of my heritage.'

Tung also revealed that her attacker spat on her multiple times during the encounter.

'There's something wrong with her,' Tung added. 'I think she should be locked up at this point, and I'm lucky that it was me and not sometime else who wouldn't defend themselves.'

According to ABC, she suffered lacerations to her face.

Lushchinskaya was initially detained by another subway rider, who restrained her until police arrived. She was later charged with felony assault, marking the second time this year that she got in trouble with the law because of her conduct on board the D train.

Online records show that Lushchinskaya, who also uses the name Anna Luschchinsky, is an attorney with a small private practice in the Sheepshead Bay section of Brooklyn.

She graduated from New York Law in 2004 and earned her license later that year. She has no history of public discipline, according to the New York State Unified Court System's website.

Tung says she is afraid to run into Lushchinskaya again because she knows the woman often takes the D train.

The blonde aggressor then slaps at the other woman's hand, and appears to begin preparing for combat by taking her sunglasses and gloves off, pulling her hair back, and whipping out her umbrella.

After a minute of such agitated preparations, Lushchinskaya suddenly kicks the other woman, who kicks her back.

Other passengers intervene and try to break up the fight. 'Yo lady, just chill out ok?' one says, while another shouts 'please stop'.

'You're not letting me hit her back!' complains Lushchinskaya, who goes on to call a man who is trying to stop her a 'f**king retarded'.

Lushchinskaya wields her small umbrella as a cudgel and continues to try to kick the other passenger as others hold her back.

The woman who is being attacked, who has been silent throughout, finally pipes up, saying: 'You come touch me, I will punch you right back. I don’t care who the f**k you are.'

As Lushchinskaya continues trying to beat the woman, now identified as Tung, with her umbrella in a rage, a man intervenes and grabs the umbrella from her.

'You're going to make us all late for work, b***h,' one man says.

Lushchinskaya spits on the floor and again screams 'f**k off' as she flicks off the woman she had been trying to fight.

'F**king ch**k,' Lushchinskaya then screamed at her foe, drawing gasps from the crowded train.

'What! What!' shouts Ayala, the man filming the video. 'Your white privilege ain't working over here, get the f**k out of here.'

'You already know she voted for Trump,' he continues.

Ayala, who hosts a podcast titled , then swooped into action to make a citizen's arrest until police arrived.

'She tried me so I had to detain her until the cops showed up,' he said, posting a photo of himself holding her hands behind her back.

Another photo shows police taking Lushchinskaya into custody.

New York state law permits any private person to use physical force, other than deadly physical force, to detain a person who commits a felony in their presence, and is in fact guilty of the felony.

It is apparently not the first time Lushchinskaya has gotten into altercations on the subway.

On Monday, one day before the D train arrest, a Twitter user posted a photo that appears to be Lushchinskaya, saying that on the R train 'this woman shoved me nearly on the the tracks with a [fist] full of keys then threaten to hit me w her umbrella'.

Court records also show that Lushchinskaya was arrested in June on charges of menacing, harassment, assault and criminal weapons possession after allegedly pepper-spraying a man on the D train at the 36th Street station.

Anna Lushchinskaya, 40, of the Sheepshead Bay and Sunset Park neighborhoods of Brooklyn went berserk on the D train Tuesday morning, physically and verbally assaulting a young Asian woman in a racist attack. The several-minute long incident, captured on video, is a shocking, and seemingly random, racist attack that stunned strap-hangers and around 10 million others who have seen the videos.

Lushchinskaya, or Anna Lushchinsky, the name she used in her career as an attorney, was arrested and charged after the drama on the D.

And it turns out, this is not the first time she’s been maniacally violent on the subway. Or even the second. She’s facing more than a dozen charges, court records show. But, she was released from jail the first time without bail and now, released again on just $1000 cash bond.

Here’s what you need to know:

1. It’s 7:50 a.m. Aboard a Packed D Train Rolling Through Sunset Park. Inexplicably, Anna Lushchinskaya Decides to Begin a Violent, Racist Tirade & Assault on a Young Asian Woman



On a packed New York City subway during the morning commute Tuesday, Lushchinskaya screams at, strikes, spits at and yells racist slurs at a young Asian woman identified by the New York Daily News as Michelle Tung, 24, before being detained and then arrested.

Twitter user PlatanoMan, real name Juan Ayala, not only captured the incident in a serious of videos but took Lushchinskaya down and then held her until New York City Transit Police arrived.

Here’s what happened:

In the first video, Lushchinskaya screams, ‘Fu*k off,” a number of times, strikes Tung with her umbrella and heavy keys and, attempts to kick Tung. For no reason. Then, Lushchinskaya repeatedly kicks Tung who was simply standing on the train. Tung then tries to defend herself and stop Lushchinskaya from kicking her. That’s when others intervene. Lushchinskaya, with a Russian accent, screams that the man who has stepped in her way is preventing her from hitting Tung and then Lushchinskaya lunges at Tung, who now begins to fight back. All the while, the dyed-blond Lushchinskaya, carrying a Louis Vuitton bag, kicks, strikes, and screams. People in the train are begging her to stop the attack. She then uses the metal part of her umbrella and again, strikes Tung, who is still trying to defend herself. People in the subway car are pleading for Lushchinskaya to stop.

2. The Scene is Captured on Video by New Yorker Juan Ayala, AKA Platano Man, Who Goes From Recording the Assault to Making a Citizen’s Arrest



The entire scene is being recorded by Ayala, who goes by PlatanoMan on Twitter and Facebook. He initially provides some comic relief by turning the camera phone on himself making what’s-going-on faces, but soon finds himself very much part of the action as opposed to just documenting it.

In the second part of his video, Lushchinskaya continues to fight, scream and then, attack the girl with her closed umbrella, stabbing at Tung. People are yelling, “What are you doing? Stop! What are you doing?”

Then, shockingly, as she appears to be using her phone to call the police, she spits at Tung and then yells at her, “Fu*king chink.” People are stunned, screaming at her. “Get the fu*k out of here with your racist shit.”

But she does not stop and turns her venom on Ayala.

3. Lushchinskaya Spits at & Calls Ayala Muhammad Atta, the 9-11 Bomber. Ayala is Latino



Lushchinskaya appeared unfazed and when Ayala asks if her plan is to continue to attack people, “So you’re just going to pick fights with everybody on the train now? Is that what you’re going to do?” Her response was to spit on him. She then calls him “fucking Muhammad Atta.”

Incredulous, Ayala responds: “Bitch, I’m Dominican.”

As he tells her the “whole world is laughing at you,” while he continues to record her, she then smacks his headphones out of his hands and then tries to smack his phone out of his hands. Ayala, fed up, shouts, “I’m not the one,” and takes her down to the floor.

Minutes later, when the train stops, Ayala has her in custody, her hands behind her back, awaiting police.

She is arrested.

4. Lushchinskaya Faces Menacing, Weapons, Assault & Harassment Charges. This is Not the First Time She Allegedly Committed a Subway Assault. Or Even the Second Time



After the incident, the NY Transit Police took to Twitter to thank Ayala and people who intervened and supplied police with videos and eyewitness accounts.

“ARRESTED: 40-year-old Anna Lushchinskaya was arrested by officers from Transit District 34 in Brooklyn and charged with felony assault in this case. Thank you to everyone who intervened and provided information.”

According to New York court records on the Dec. 11 attack, she is facing five charges: an A misdemeanor, menacing in the second degree with a weapon other than a gun; another A misdemeanor, fourth-degree criminal possession of a weapon used in an assault; a B misdemeanor, third-degree menacing; another B misdemeanor, attempted assault with the intent to cause physical injury; and a criminal violation, harassment in the second degree.

Records show that she bonded out on $1000 cash bail and has an order of protection, presumably prohibiting her from contact with Tung and perhaps others on the train; the parameters are not made clear in case records. She has a Legal Aid lawyer, Jacob Bradley Rolls. She is due back in court Jan. 22, 2019. Legal Aid is provided to the indigent, people who are poor or otherwise cannot afford a lawyer. Lushchinskaya is a lawyer who reportedly earns $110,000 a year.

“The Legal Aid Society exists for one simple yet powerful reason: to ensure that no New Yorker is denied their right to equal justice because of poverty,” the website says.

And, it turns out this is not the first time that Lushchinskaya has been violent on the Manhattan D or R trains, and in the same general location, 36th Street in the Sunset Park section of Brooklyn.

According to court records, Lushchinskaya was charged after allegedly pepper-spraying a man on the train on June 28. That man told the Daily News he and others on the train, soon filled with a cloud of the noxious spray that attacks mucous membranes in the eyes, nose, throat, and lungs, terrified, thought it was a terror attack.

In the June case, Lushchinskaya was charged with two counts of misdemeanor assault. She was also then given a Legal Aid lawyer and was released on her own recognizance, in other words, she walked out of jail sans bail. She apparently did not show up for a fall court date and in November a warrant was issued for her arrest. When she did appear in court on Nov. 16, she was again released without posting any bail. She had a court date on Dec. 13, the same day of the D train incident and on the June case, was again ROR’d. But court records appear to show that both cases have now been combined and in total, she is facing 10 charges with several counts each of menacing and harassment.

None of the charges of menacing, attempted assault and harassment which appear racially motivated in nature, are listed as hate crimes.

Days before, Gothamist reported Lushchinskaya allegedly struck at another subway passenger.

“”As I was passing her she stuck her arm out and like, side punched me with her keys in her knuckles …I stumbled, caught myself, kept walking and turned around because she was screaming at me to leave her alone. She called me a ‘psycho bitch,’ and I still had my headphones on so I couldn’t completely catch what she said because I was so taken off guard.”

That passenger said she informed transit police right after the incident and followed up with an email but has not heard back.

5. Records Show That Lushchinskaya Was Licensed as a Lawyer in New York in 2004 & Was Named a Member of the NY Bar Association in 2005

According to online records and reports, Lushchinskaya, who is listed under the name Anna Lushchinsky, was admitted as an attorney in New York State in 2004 and was named as a new member of the New York Bar Association in 2005 for the second district, which covers Brooklyn.

And according to Dun & Bradstreet, she has a law practice in Sheepshead Bay with two employees. It’s reported that her practice earns $110,000 a year.

According to a LinkedIn profile that appears to be that of Lushchinskaya, known as Lushchinsky, she did indeed graduate from New York Law School, worked as an attorney for the Law Offices of Tarasov & Associates until 2013, and attended Hunter College.

The profile says Lushchinsky is skilled in personal injury and immigration law, among other specialties. A cursory search of New York State court records with her listed as attorney found no pending cases.
