Instead of simply using % values to determine level of risk and reward, include in the equation the probability of the particular move. For example, an 80% likelihood of a 20% gain offsets a 20% likelihood of an 80% loss. Those who are shorting KRY currently obviously believe that a $1-1.5 loss is *much* more likely than a $10 gain. I'm no mathematician, but thats my $0.02

Ward was explaining he thinks he can spot, from TA, which side the CSJ ruling will favor just in advance of it's being made public. If he senses the ruling will favor KRY, he will cover and go long to be on "our" side.
