Nevada Becomes First State To Ban Pre-Employment Marijuana Testing

Nevada state governor makes it unlawful for Nevadan employers to refuse employment based on positive marijuana tests.

Democratic Governor Steve Sisolak signed a law this week which would make Nevada the first state to ban pre-employment marijuana tests, ABC news reported.

Assembly Bill No. 132 (AB132) stipulates that employment can not be rejected “because of the presence of marijuana in a screening test taken by a prospective employee.”

However, the law does involve exceptions. “Those trying to become firefighters or EMTs cannot test positive, as well as those applying for jobs that require someone to operate a motor vehicle or jobs with the federal government,” according to the bill.

The law goes into effect January 2020.

New York City passed a similar bill in April which banned employers from requiring a passing marijuana screening test as a condition of employment. Maine does not have laws concerning drug testing, but employers are not allowed to discriminate based on marijuana usage.
