Hard to believe that Mr. Yocam posted here without first consulting with the legal wannabes. Anyway as long as his comments are not speculative and construed as "forward hoping" I don't see the harm. Don't see the legal issues involved if Mr. Yocam articulates the company's strategy and vision in a "just-the-facts-ma'am" fashion. Or perhaps he should cut and paste the boiler-plate forward looking mantra that accompanies all publicly traded company financial releases to his comments. That may do it (and then again I don't have a clue.)

But this is still very cool.

I agree with your concern about Del's comments here but since he is smart enough to get where he is, I doubt he is sitting at a keyboard somewhere spontaneously wondering whethe he should let vital info out. In fact, although he may personally read this thread, I doubt he sits and hunts and pecks the fonts himself. I would be disappointed if he wasn't more or less simply signing off on whatever his IR-via-the lawyers- allow him to sign off on before it would get typed here. Also, I bet there are no typos in his posts (g). Now then, to Del: As my current hero, I hope you won't let me down and you did what all good heroes would do and that is under-promise and over-deliver on you earnings pre-announcement. Meeting expectations would be under-delivering at this point; beating them by a sizable amount would be the only rational explanation for preannouncing as you did. At least that was my thought as I was buying at sub-7 levels, FWIW. Jim

erin4,

This is not the first time CEO from BORL post on this forum. BORL went
down the drain at one point and CEO had to respond to share holder's
fears. I understand your concern about lawyers( I have few of them in
my family), but it is important for today's ceo to take care of share
holders
. Look at BORL's volume, even small 100 share counts. Yes,
there was one lawsuit case as I remember, but that was a penny stock
and it was ... BORL is far from it. MU CFO/CEO used to come on SI.
Cyrx official use to interact with SI daily bases.

Majority folks here are techies and few of us are in finance, so this
is new wave to get direct feed back from consummers/investors.
Where else can he get straight forward feed back, but from us?

regards,

BPP(Bipin's partner)

While I'm impressed that Mr. Yocam is talking to his stockholders via AOL I believe he should get some legal advice about continuing to do this

So, are you suggesting Mr. Yocam shouldn't ever discuss anything in a public forum, period? I suspect your concern is misplaced.

David

Don't believe for a second that Mr. Yocam got on this thread without the sound advice of a lawyer, CEO'ng 101.
Besides he said nothing that could ever be used against Borland.
Sit back and enjoy the fact our little thread has a participant of his stature.
