I missed that point (and it is probably the best one). With that they're saying to us holders, "We won't let you hang another 13-weeks for an update. We'll update you sooner."

That is very comforting news.

CTC Communications Wins First Round in Dispute with Bell Atlantic

U.S. District Court in New York denied Bell Atlantic's request for arbitration thereby ratifying CTC's right to a jury trial in the suit CTC filed against Bell Atlantic in U.S. District Court in Maine last December. Mr. Robert Fabbricatore, CTC's Chairman and Chief Executive Officer, said that this is very positive news for CTC. ''In denying Bell Atlantic's request for arbitration, the Judge ensured that CTC's anti trust case against Bell Atlantic will proceed expeditiously.''

Judge Kimba Wood of the U.S. District Court in Manhattan has issued an injunction against CTC and ruled that Bell Atlantic is likely to succeed on the merits of its claim that CTC violated the non-compete clause in its sales agency contract with Bell Atlantic. Bell Atlantic terminated that contract last Dec. 30 after CTC decided to become a reseller of local telephone service and compete for the same Bell Atlantic customers it had previously serviced as a sales agent.

The injunction, contained in a decision handed down by Judge Wood last Friday, prohibits CTC from doing the following:

-- Selling or promoting the sale of any telecommunications services to any
Bell Atlantic business customer to whom CTC has sold Bell Atlantic
services in the 12 months prior to Dec. 30, 1997.

-- Using any of Bell Atlantic's trademarks and trade names in promotions,
advertising or other market material without the written permission of
Bell Atlantic.

-- Using Bell Atlantic's customer information, price lists or any other
confidential information that CTC acquired as a sales agent for Bell
Atlantic.


CTC reports this only affects 4% of it's billing in the current marketplace. And they will push aggressively for the restraining order to be overturned. Suffice it to say, punches begat punches. CPTL took quite a hit today.

For me, I may lighten up and take some losses. Then determine if I want to reinvest after a month has passed. Other thoughts?

For now, my money is going elsewhere.

Yesterday I cried "Uncle" and sold out entirely. I wish the company and it's shareholders good luck against BEL.
