Oddly, lending employee's retirement money out as financing for customers wouldn't be legal in the US as it's not an "arm's length transaction" - ie. the borrower is "a related party".

If Siemens was a US companies they could invest their employee's retirement money in Siemen's stock or lend it out to far worse borrowers - they just have to be borrowers the company is not doing business with.
