That's why the suit is a RICOH suit. An individual can not short a stock without the compliance of a Market Maker who will permit naked shorts under the table. If you also have an internet strategy to pull down a stock, you can have an effective campaign. It is also a conspiracy to manipulate a stock which is illegal.

A conspiracy is:
1. An agreement to perform together an illegal, wrongful, or subversive act.
2. A group of conspirators.
3. Law. An agreement between two or more persons to commit a crime or accomplish a legal purpose through illegal action.
4. A joining or acting together, as if by sinister design: a conspiracy of wind and tide that devastated coastal areas.

One other point. People may have different motivations in the conspiracy. The law doesn't care. Even if you are attempting to accomplish a legal purpose, you are still guilty of conspiracy if you pursue illegal activity to reach your goal.
