IEG and Michaels are embroiled in a legal battle over whether the Seattle company has the right to show a sex-filled video featuring Michaels, a singer with the group "Poison," and his former girlfriend, television actress Pamela Anderson Lee. Michaels obtained a temporary restraining order January 23 blocking IEG from putting the video on its www.clublove.com Web site starting Monday. Michaels also asked for an award totaling $90 million, claiming that by showing the tape and its numerous closeups of his private parts his career would be irreparably harmed. IEG contends the singer is simply trying to wrest more money from the company than it had been willing to pay him. Michaels alluded to his willingness to have the video made public if he received enough money from the exhibition when he appeared on a national radio program (Howard Stern) January 23, according to IEG President Seth Warshavsky. "IEG is willing to pay Michaels. However, we are confident that we own the copyright and all other intellectual property rights to this video, and we will actively pursue anyone, including Michaels, who infringes on our rights." IEG says it will seek on Monday (Jan. 26) to increase a $50,000 bond posted by Michaels to several million dollars, and will ask for dismissal of the case at a hearing the following Monday. IEG, which has been in the entertainment headlines recently after it released another steamy video featuring Pamela Anderson and her husband, rock drummer Tommy Lee, had been negotiating with Michaels for the past two weeks concerning its intention to put the tape on www.clublove.com and then release VCR tape and DVD versions for sale in video stores. IEG says the tape is "hard core sex for the true voyeur." Derek Newman, staff counsel for IEG said that Michaels' attorney, Edwin F. McPherson, did not provide notice to IEG before seeking the temporary restraining order, as is customary. He said IEG was confident it would have been successful in blocking the restraining order if it had been able to present the facts to Federal Judge Dean Pregerson of the Central District of California. IEG said it intends to file a grievance with the California State Bar Association against McPherson for what it considers underhanded and unethical behavior for not providing notice of Michaels's intention to try to block release of the video. IEG had provided written assurance to Michaels that it would not air the tape pending a judicial decision if the case went before a court. Adult Video News, the trade magazine for the adult products market, reported this week that IEG's "Pamela & Tommy: Hard Core and Uncensored" video tape version had zoomed to the top of the charts for adult videos.
