They got the DOJ to say that removing IE in it's entirety was not the relief it wanted, then got out of Jackson's court ASAP to focus on the appeal of his actions beyond denial of the original contempt request. They gave Klein a way to get out and save face, should he find reason to do so.

Honestly, did you think what the DOJ wanted in it's request for injunction was for MSFT to remove the lousy icon from the desktop? I read it and I didn't. It seems the injunction accomplishes nothing as settled. Do you disagree?

However, I do think some of the pointed words were uncalled for, and was glad to see MSFT acknowledge this publicly. It was unprofessional to use the phrase "poorly informed lawyers" in their brief. Further, I'm sure Ballmer wishes he hadn't said "to heck with Janet Reno" though I suspect it sounded a lot different at his motivational sales meeting than it did as reported in the press. Finally, I do not agree with the "ham sandwich" overstatement which I think would warrant a tying investigation, though I firmly believe that web browsers are very reasonable OS extensions.

BTW, I did not say I thought this was going away, and in fact, believe MSFT will continue to be watched closely as long as they remain successful. What I said was, as an investor, I'm happy with the result thus far.
