I believe it is legal to short through Canada(or anywhere outside the US). If it was truly long with delayed delivery, I would think they'd ask for the money after 3 days. That's why I think it was a true short(just guessing), you can stay short as long as you like until someone comes looking for the shares. Someone more knowledgeable would have to speak on whether selling "Long with delayed delivery" can be turned into a true short sale. I think, under normal circumstances, if you fail to honor the three day settlement you are banned from trading for 30 days(something like that). I don't believe any of this is under normal circumstances. Remember, Mork specializes in trading so to think this is some poor guy who tried to help a friend is stretching it(IMO).
