It's a PR thing. MSFT needs to present a more reserved and selfeffacing image to the media because the media influences public opinion. Public opinion inturn influences the government which inturn initiates antitrust actions.

The media wants to tell a simple story. That story is MSFT bad, Netscape good. That's why they describe the issue using simple words like Microsoft "capitulated" Microsoft "arrogant", "petulant", "bully", "raised middle finger", "monopoly" etc.

People love to root for the underdog. And Netscape is the underdog. The media naturally tap into this sentiment.
