Don’t know. The Court of Appeals did not ask for responses and did not set a schedule calling for them.

Sullivan’s only arguable point is that he hasn’t decided anything yet. Until he does, mandamus is an unnecessary remedy. It’s not much of a point, IMO, because the filing of the DOJ’s motion to dismiss required him to act promptly without asking for amicus briefs, which are not contemplated under law in criminal cases at the trial court level.
