The condition that 50% or more of orders placed must come through WebBroker has been a condition since they began their flat-rate plan. It is specified in the documents for WebBroker access.

So, if you place 20 trades a year, at least 10 of them must be through WebBroker or Waterhouse has the right to convert your fee plan to the standard rates. This is reasonable, since they offer the flat-rate plan to save money and they probably lose a little on each flat-rate trade placed via their private network, touch-tone, or live broker.
