I don't believe that NMS is required for a stock to be marginable. Datek mentioned that the Federal Reserve Board (FRB) has given permision for brokers to provide their clients with margin. Each broker-dealer then makes their own determination if they will allow you to margin the stock. The FRB's approval is positive indicator of just how imminent NMS is. This is definetly a bonus for E-Trade and Datek clients, I never thought I would actually give these discount brokers so much credit. Maybe there is hope for discount brokers afterall/
