I suppose the final outcome will all come down to how blackmailed Chief Injustice Roberts votes It may not depend on how Justice Roberts votes anymore. The court has 5 justices that are constitutional originalists without him. The vote on whether the Pennsylvania supreme court can overrule the PA state legislature goes explicilty against the constitution since it states there that legislators determine the voting rules and the PA state legislature explicitly decided not to allow ballots after the deadline as recently as August. Then the Supreme Court overruled and Roberts was on a 4-4 decision that didn't overrule the State Supreme Court. But with Amy Barrett there now, it could easily go 5-4 or maybe Roberts would change and it would be 6-3.
