Fraud is when you made gains by committing a crime. Statue of limitation is seven years. No place on earth, can any criminals hide anymore. Brazil and Cuba used to take all your money anyway. Safest way out, for the Bre-x officials, is to invest all their personal money back into the company. And go back to work in the company for a living. Being paupers, can get themselves out of troubles in the long run. Otherwise, the lawyers take all the money sooner or later. If the company is not being liquidated, stockholders can not sue for permanent losses. If stockholders can not sue, the company is not in receivership. Most problems can be worked out later.
