Short answer would be yes - long answer would be prove that in a real criminal court and then the Senate can take it up and censure.
The trial IS the censure.

It's one thing to argue that this is a waste of time (although in my mind, the less the Democrat-controlled Senate accomplishes, the better).

But it's yet another to argue that this is unconstitutional.
