DEC sued Intel for use of Alpha pattens. The settlement was the sale of the DEC chip plant and the right to Intel to use the Alpha pattens. Intel must produce Alpha chips for DEC as long as DEC orders Alpha chips. DEC did not sell ownership of the Alpha - just the chip plant and it licensed Intel to use Alpha pattens - DEC retains ownership of Alpha. Alpha is also produced by two Japanese chip plants. DEC was loosing money on its own chip plant due to low demand for Alpha verse the capacity of the chip plant (couldn't achieve full utilization) plus Alpha does not achieve the same yield rate as the Pentium.
